Patient Binge Service Terms

These Service Terms apply when you purchase or use Patient Binge™.
Patient Binge™ is provided by Ryan Galbraith, ABN 56 622 607 408, trading as ChiroBrand.
By purchasing Patient Binge, you agree to these Terms.
1. Who Patient Binge Is For
Patient Binge is a business-to-business service for chiropractic practices.
By purchasing the service, you confirm that you are purchasing it for use by a chiropractic business or practice.
2. What You Receive
Patient Binge provides recurring marketing and patient education resources for chiropractic practices.
The exact mix of assets may change from month to month.
A campaign may include:
Social media content
Captions
Patient emails
Articles
Guides
Infographics
Videos
Campaign maps
Supporting marketing resources
ChiroBrand may reasonably adjust the format or mix of assets while continuing to provide the core Patient Binge service.
3. Monthly Membership
Patient Binge is a recurring monthly membership.
The price shown when you purchase will apply unless you are told otherwise before purchasing.
Prices are in Australian dollars.
GST will be applied where required by law.
Your payment method will be charged according to the recurring billing schedule shown at checkout.
4. Cancel Anytime
There is no fixed-term contract unless clearly stated when you purchase.
You may cancel your recurring membership at any time.
Cancellation stops future recurring charges.
Where the payment platform allows continued access until the end of an already-paid billing period, your membership may remain active until that period ends.
You may keep materials already delivered to you while your membership was active, subject to the licence terms below.
5. Postcode Protection
Patient Binge is limited to one approved chiropractic practice per postcode.
When your membership becomes active, your approved postcode may be marked as unavailable to other Patient Binge applicants.
Postcode protection applies while your membership remains active.
Once your membership ends or becomes inactive, ChiroBrand may release that postcode for another practice.
Postcode protection applies only to access to Patient Binge.
It does not give you exclusive rights over a geographic area or prevent another chiropractic practice from operating in your postcode.
6. Postcode Accuracy
You are responsible for providing the correct postcode for the clinic using Patient Binge.
If your clinic moves or you want to use Patient Binge for another location, contact ChiroBrand first.
Postcode changes are subject to availability.
7. Content Licence
ChiroBrand gives your approved chiropractic practice a non-exclusive, non-transferable licence to use the Patient Binge materials delivered to you.
You may:
Add your logo
Apply your clinic colours
Publish the materials through your clinic's normal marketing channels
Continue using materials already delivered after cancellation
You may allow employees, contractors, virtual assistants or marketing providers working for your practice to access the materials only to help your practice use them.
They do not receive their own separate licence.
8. What You Cannot Do
Unless ChiroBrand gives written permission, you may not:
Sell Patient Binge materials
Sublicense them
Give them to another chiropractic practice
Upload them to a public template library
Distribute editable source files outside your practice and authorised contractors
Claim ownership of ChiroBrand trademarks, systems or original frameworks
Use the materials for multiple unrelated practices or locations without approval
9. Sharing Between Practices
You must not share Patient Binge campaigns with another chiropractic practice.
If we reasonably believe a membership is being shared outside the approved practice, we may contact you to resolve the issue.
For serious or repeated misuse, we may suspend or end access.
Where appropriate, we will give you reasonable notice and a chance to address the issue first.
10. Evidence and AHPRA Alignment
Patient Binge campaigns are developed using current research and reviewed with Australian chiropractic advertising requirements in mind.
However, ChiroBrand is not your legal adviser, regulator or clinical decision-maker.
Advertising rules can change, and compliance can depend on how material is finally used.
Your practice remains responsible for:
Reviewing content before publication
Ensuring claims accurately reflect your services
Checking any additions or changes made by your practice
Complying with AHPRA, National Law and other rules that apply to your practice
Our Evidence-Backed Guarantee means campaigns are developed using current research and checked for AHPRA alignment as part of our production process.
It does not mean a regulator has approved every campaign or every possible use of the material.
11. Clinical Information
Patient Binge materials are designed for patient education and marketing.
They are not a substitute for individual clinical assessment, diagnosis or treatment.
Your practice remains responsible for the clinical advice it provides to patients.
12. No Guaranteed Business Results
Patient Binge provides marketing and communication resources.
We do not guarantee:
New patients
Appointments
Referrals
Patient retention
Revenue
Social engagement
Website traffic
Return on investment
Business growth
Results will vary between practices.
13. Bonuses
Patient Binge may include bonuses from time to time.
Some bonuses may only be available during certain promotions or joining periods.
Unless stated otherwise, bonuses already delivered to you may be retained after cancellation, subject to the same content licence.
14. Delivery
Patient Binge is mainly delivered by email and online links.
You are responsible for:
Providing a working email address
Checking your email
Keeping your contact details current
Taking reasonable steps to ensure ChiroBrand emails are not blocked by your email provider
If you believe a campaign or resource has not arrived, contact support@chirobrand.com.
15. Third-Party Platforms
Patient Binge may use third-party services such as Kit, Canva, payment processors, cloud storage or other software.
ChiroBrand does not control those platforms.
Temporary outages or changes to third-party services may affect delivery or access.
Where reasonably possible, we will work to restore access or provide another delivery method.
16. Refunds and Consumer Rights
Patient Binge does not include a money-back guarantee, and we do not generally provide refunds for change of mind.
Nothing in these Terms limits any rights or remedies you may have under the Australian Consumer Law.

17. Changes to Patient Binge
We may make reasonable changes to Patient Binge over time.
This may include changes to:
Campaign formats
Delivery methods
Asset types
Software
Templates
Production processes
We will not use this clause to remove the core substance of the service without reasonable notice.
18. Pricing Changes
We may change the price of Patient Binge in the future.
If a price change affects your existing recurring membership, we will give you reasonable notice before the new price applies.
You may cancel before the new price takes effect.
19. Suspension or Termination
We may suspend or end a membership where reasonably necessary because of:
Unpaid fees
Fraud
Serious misuse of the materials
Unlawful activity
Repeated breach of these Terms
Where appropriate, we will give you reasonable notice and a chance to fix the issue.
20. Intellectual Property
Patient Binge™, ChiroBrand and related original frameworks, branding, systems and materials remain the intellectual property of their respective owner.
Your purchase gives you the licence described in these Terms.
It does not transfer ownership of the underlying intellectual property.
21. Liability
To the maximum extent permitted by law, ChiroBrand is not responsible for indirect or consequential business losses resulting from your use of Patient Binge.
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited.
22. Governing Law
These Terms are governed by the laws of Victoria, Australia.
The parties submit to the jurisdiction of the courts and tribunals of Victoria and any courts entitled to hear appeals from them.
